Terms and conditions 

The following terms and conditions (“Conditions of sale”) apply to the offer and sale of products: (1) through the HIRICA website located at www.hirica.fr (the "Website"); or (2) by phone by contacting our Customer Service department on +33 (0)5 58 77 19 10 (Monday to Friday: 9am – 5pm, Paris time zone) or by email at contact@hirica.fr. These Conditions of sale apply exclusively to sales made on the website or at the head office. Sales made through authorized resellers are not subject to these General Conditions of Sale. Our customer service team can only provide assistance to customers in English and French. By checking the corresponding boxes during the ordering process or registering an account on the Website, you acknowledge you have read, understood and accepted, without limitation or reservation, these Conditions of Sale, as well as our Privacy Policy.

2. General provisions

2.1 To be eligible to purchase products on the Website or by telephone at our head office the user must: (a) be at least 18 years old or, if they are minors, be duly authorized by their legal representative; (b) be consumers, considered as natural persons acting for purposes unrelated to their trade, their business, their career and their profession; and (c) hold a valid credit or debit card.

2.2 These conditions of sale are available in French and English and are governed by French law. Before placing an order for a product on the Website or by telephone at the head office, customers must expressly accept these General Conditions of Sale. Customers can save or print these Terms of Sale, also available at any time on the Website. These Conditions of Sale can be modified at any time by Hirica.

2.3 The Conditions of Sale applicable to an order are those published on the Site (i) when an order has been placed on your behalf by a Customer Service representative (when the order is placed by telephone at the head office) or (ii) when the customer places an order (in the case of an order placed via the Website). In accordance with applicable laws regarding electronic signatures, placing an order as described below will be considered as an electronic signature and proof of the order and the amount due.

 

3. Products

3.1 Information on the products is available on the Website or by telephone at the head office and is provided in accordance with French law (or any other applicable law).

3.2 We will take all reasonable measures to ensure all the details, descriptions, images of the products appearing on the Website are correct at the time when the relevant information is entered into the system. However, to the extent permitted by applicable law, we do not warrant that these details, descriptions, product images are accurate, complete, reliable, current or error free.

4. Price

4.1 All the prices indicated for the products available on the Website or by telephone at the head office are indicated inclusive of tax and are expressed in euros. The delivery costs are visible to the customer before completion of an order and will be added to the price of the products.

4.2 We regularly check that all the prices displayed on the Website are correct, however, we cannot guarantee that there are no errors. In the event that an obvious error on product pricing is detected, we will offer the customer the option of purchasing the product at the correct price or cancelling the order.

4.3 Prices can be modified at any moment by Hirica. The applicable prices will be those published on the Website on the date the customer places an order.

5. Placing an order

5.1 The customer can browse freely on the Website without being obliged to place an order. If the customer chooses to do so, the customer will be guided through the process of placing an order via a series of simple instructions on the Website or by telephone with the head office.

5.2 HIRICA reserves the right to limit the quantity of products that can be ordered by the customer in a single purchase session via the Website or by telephone at the head office. 

5.3 The customer must click on "Add to cart" to place the selected product in the desired quantity in their "Basket". The customer can decide to continue buying other products and add them to their basket or proceed to the checkout by clicking on the "Proceed to checkout" button. At any time during their shopping session, the customer can consult the products in their basket by clicking on "Basket". The customer can remove products from their basket by clicking on "Delete" next to the product chosen in their "Basket". The customer can also call the head office and a sales representative will provide the customer with product information and help them complete their purchase.

5.4 The customer must follow the on-screen instructions to follow the payment process on the Website. The customer can always correct errors in the data entered, modify the contents of the basket, add or remove one or more products from the basket or cancel the entire order at the checkout time before placing the order. Before submitting an order on the Website, the customer will be able to review and modify all the details of her/his order, including billing and shipping information, before confirming their purchase. In addition, the customer acknowledges and declares to have read all of the instructions provided during the ordering process and accepts the General Terms and Conditions of Sale, by confirming this on the Website (for example by checking a box). The customer places an order for a or several products via the Website by clicking on the [“Place order”] button at the end of the order process. When you order by phone at the head office, a sales representative will follow the order process on your behalf.

5.5 Once the order has been placed, a submission page will be displayed, and the customer will shortly thereafter receive an email confirming receipt of the order placement. In accordance with the provisions of French law, the order confirmation email contains a summary of the Conditions of sale, information on the essential characteristics of the products purchased, a detailed indication of the price and means of payment, information on costs, delivery, information on the conditions and means of exercising the right of withdrawal, the address to which complaints can be addressed to, information on support services and on existing commercial guarantees.

5.6 If an order confirmation email does not arrive within twenty-four (24) hours after the submission of the order, the customer can contact us on +33 (0)5 58 77 19 10 or by email at sav@hirica.fr  to receive support. Please note we can only offer customer support in English and French.

5.7 If customers have questions or concerns when placing an order or if they wish to inquire about a previously placed order, they can contact us on +33 (0)5 58 77 19 10 or by email at sav@hirica.fr. For faster service, customers should provide their order number. Please note we can only offer customer support in English and French.

6. Promotional codes

6.1 To use a promotional code, the user must enter their code into the “Promotional code” box during the payment process on the website. Please pay careful attention to the upper- and lower-case letters, numbers and punctuation or the code may be refused.

6.2 When a promotional code is accepted, the promotion will be displayed on the order review page.

6.3 You can only use one promotional code per order, they're not accumulative.

7. Payment Options

7.1 Customers can pay for products by debit or credit card and through PayPal. The HIRICA company accepts the following credit or debit cards: Visa, MasterCard, Debit card and American Express.

7.2 The HIRICA company will authorize and process your payment when you submit an order to purchase products on the Website. Your payment card will be billed with the purchase price applicable at that moment. By submitting your order on the Website or by telephone at the head office, you expressly authorize the HIRICA company to carry out this payment card authorization and, strictly for legitimate purposes and to the extent authorized by the regulations in force, to transmit or to obtain information (including any updated information) about you or from third parties, including but not limited to your payment card number, to authenticate your identity, to validate your payment card, to obtain a payment authorization and to authorize individual purchase transactions.

7.3 For customer security, the customer's name and billing address must match the credit card used for payment. Hirica reserves the right to cancel any order which does not fulfil the aforementioned criteria.

7.4 All credit card holders are subject to validation and authorization checks by the credit card issuer. If, for whatever reason, the issuer of the user’s payment card refuses or does not authorize the payment to HIRICA, in advance or following a payment, we will not be responsible for any delivery delay or non-delivery.

7.5 If you order by telephone at the head office, you must communicate your card number and your three-digit security code printed on the front or back of your card (CVV2 / CVC2 / CID) to the head office. Please refer to our Privacy Policy for more details on the processing of your personal data.

8. Requests for order information

8.1 The company HIRICA makes every effort to have your products shipped within 48 hours of receiving an order. For any information related to shipping, customers can contact HIRICA by phone: +33 (0)5 58 77 19 10 or by email at sav@hirica.fr.

8.2 Customers can check the status of their latest orders by consulting the "Order history" page under "My account". It’s the easiest and fastest way to get the latest information on customer orders.

8.3 When the customer clicks on the “Order history” page, they will be invited to log in with their email address and their password. An order summary page will provide the customer with detailed information on their current and past orders. After placing an order, the relevant tracking information, if available, will be attached. The customers can follow the delivery status by consulting their “Order history” page.

8.4 The HIRICA company reserves the right to cancel orders or parts of an order for the following reasons: - Its impossible to process payment information - Its impossible to deliver to the indicated address - Unavailable item(s) - Duplicated order - Cancellation at the customers request

8.5 If a request is cancelled, the customer will receive an email explaining the reason for this cancellation. The customers will not be invoiced for cancelled orders. If the customer wants to place a new order or the customer has questions concerning a cancelled order, they can contact the HIRICA company on +33 (0)5 58 77 19 10 or by email at sav@hirica.fr.

9. Delivery

9.1 Orders can only be delivered on working days between Monday and Saturday (excluding holidays). Orders placed on Saturday and Sunday will be processed the next working day.

9.2 The HIRICA company delivers in mainland France and Europe. You can consult the list here.

9.3 Delivery costs in a relay point are at the expense of HIRICA, however, if the customer wants a different delivery option than the one offered by HIRICA, the customer needs to pay for the delivery cost. For more information regarding shipping costs, consult our Delivery page.

9.4 Once an order is processed and ready to ship, the HIRICA company will send you a confirmation order by email. You can access a tracking number to track your order’s status online by consulting the “Order history” page under “My account”.

9.5 The HIRICA company makes every effort to respect the delivery times indicated on our Delivery page.

9.6 In accordance with articles L.216-1 to L.216-3 of the French Consumer Code (the "Consumer Code"), products must be delivered within thirty (30) days from the day after the customer places the order unless we inform the customer, including by email, within the same period, that the products ordered are unavailable, including if they are temporarily unavailable.

10. Right of withdrawal

10.1 The customer has a period of fourteen (14) working days, in accordance with article 221-18 of the Consumer Code, to exercise their right of withdrawal from the contract, without having to justify their decision and from the date to which the customer or a third party designated by the customer and who is not the carrier received the products. No returns will be accepted after this fourteen (14) -day period. For any returns, please consult our Return conditions page.

10.2 To exercise your right of withdrawal, you must inform us, before the expiration of the withdrawal period, of your decision by email to sav@hirica.fr or go to your account under "my orders" where you can print a return slip.

10.3 Products purchased on the Website cannot be returned to one of our approved HIRICA retail partners.

10.4 The above provisions are only applicable to purchases made via the Website or at the head office in France. Products purchased by one of our retail partners approved by HIRICA will be subject to the return policy of the retailer in question.

11. Refunds

11.1 Following the exercising of the right of withdrawal, the company HIRICA will reimburse the customer the full price of the product(s), within fifteen (15) days from the date of receipt of its withdrawal without ambiguity, provided these have been returned without being used and without being damaged and in compliance with Hirica’s General Conditions of Sale. We may retain the refund amount until you have provided proof that the goods have been shipped.

11.2 Refunds will only be made using the same payment method you used for the original transaction. We will send the customer a notification email once the refund has been made. Only the customer will be entitled to a refund. In no event will a Gift Recipient be entitled to receive a refund.

11.3 The products must be returned in an unused and perfect condition.

12. Force majeure

We are not responsible for the non-performance or partial performance of our obligations under these Conditions of Sale in the event of a force majeure, as defined by applicable law. In the event of a force majeure, we will duly inform the customer within five (5) working days following the occurrence a force majeure event.

13. Customer service, online dispute resolution and mediation

14. Applicable law and jurisdiction

These Conditions of Sale are governed by French law and must be interpreted in accordance with French law.
